Client Policies, Terms & Conditions

 

These Client Policies (“Terms”) govern all design services provided by Evara Design Company LLC (“Evara,” “we,” “us”) to the client (“Client,” “you”). By booking a consultation, purchasing a service, or engaging Evara in any capacity, you acknowledge and agree to these Terms.

1) Services + Scope

Evara provides interior design services including (but not limited to) design consultations, interior decoration and styling, space planning, sourcing and selection of furnishings and décor, lighting selection, and home staging support.

  • All services are limited to the scope described in your selected service, invoice, proposal, or written agreement.

  • Any requests outside the agreed scope may require a revised proposal, additional fees, or a new booking.

 

2) Consultations, Scheduling, and Arrival Windows

Consultations may be held in-home, on-site, or virtually depending on the service selected.

  • Appointments are scheduled by reservation and are confirmed only after payment (or deposit, if applicable) is received.

  • Client agrees to provide timely access to the space, and to secure pets as needed for safety and comfort.

 

3) Fees, Deposits, and Payment Terms

  • Fees are based on the service selected and the scope of work.

  • Unless otherwise stated in writing, invoices are due upon receipt.

  • Late payments may pause work, delay deliverables, or result in cancellation of services.

  • Payment processing fees (if any) are non-refundable.

 

4) Cancellations + Rescheduling

Evara understands that schedules change. The following policy protects reserved time on our calendar:

  • Rescheduling: Allowed with at least [48 hours] notice.

  • Late reschedules/cancellations: Changes made within [48 hours] will be subject to a rescheduling fee or forfeiture of the consultation fee.

  • No-shows: Missed appointments without notice are not refundable and will require full payment to rebook.

 

5) Refunds

Due to the customized nature of design services, consultation fees and service fees are non-refundable once the appointment or work has been initiated.

If Evara cancels due to our own scheduling conflict, we will offer rescheduling or a refund of the unused portion of paid services, as applicable.

 

6) Communication + Timelines

To keep projects moving smoothly:

  • Client agrees to respond to questions, approvals, and requests for information within a reasonable timeframe.

  • Delays in communication may delay deliverables and timelines.

  • Evara is not responsible for project delays caused by third-party vendors, shipping carriers, product availability, discontinued items, or circumstances outside our control.

 

7) Product Selection, Trade Purchasing, and Pricing

Evara may source items through public retailers or designer trade accounts.

  • Pricing, availability, lead times, and shipping costs can change at any time and are not guaranteed until ordered.

  • If trade pricing is available, it may be reflected as a discount line item or within the final proposal structure (as determined by Evara).

  • Evara reserves final discretion over product sourcing and vendors unless Client provides written non-negotiable requirements (e.g., exact dimensions, ADA needs, finish restrictions).

  • All curated appliances, fixtures, finishes, and materials are selected to align with applicable building code requirements, manufacturer specifications, and standard installation practices. Final code compliance and installation requirements are determined by the installing contractor and local jurisdiction.

 

8) Orders, Shipping, Returns, and Damages

When Evara places orders on Client’s behalf:

  • Client is responsible for payment of approved items, shipping, delivery fees, and any applicable taxes.

  • Returns/exchanges are subject to vendor policies and may include restocking fees, return shipping, and processing timelines.

  • Evara is not responsible for manufacturer defects, dye lot variation, natural material variation, minor imperfections, or freight delays.

  • Damaged items must be reported promptly and within vendor claim windows. Evara will assist with reasonable claim coordination, but outcomes are determined by the vendor/carrier.

 

9) Measurements + Site Conditions

  • Client is responsible for confirming that the space can accommodate selected items (including but not limited to: door clearance, stair clearance, elevator access, ceiling heights, wall conditions, and electrical/plumbing constraints).

  • Evara may take measurements as part of service; however, Client acknowledges that onsite conditions and existing construction variability can impact fit and installation.

 

10) Contractor Work + Technical Advice Disclaimer

Evara provides design guidance and product selection support. Evara does not provide architectural, engineering, or licensed trade work unless explicitly stated in writing under a separate agreement.

  • Any installation, electrical, plumbing, structural changes, or permit-related work must be handled by appropriately licensed professionals.

  • Client is responsible for verifying compliance with building codes, HOA rules, landlord approvals, and permits as applicable.

 

11) Photography + Marketing

Evara may request to photograph completed work for portfolio and marketing purposes.

  • Client may opt out of photography usage by providing written notice.

  • Any agreed photography use will respect privacy and will not disclose personal identifying information.

 

12) Intellectual Property

All design concepts, mood boards, layouts, recommendations, written deliverables, and curated selections provided by Evara remain the intellectual property of Evara Design Company LLC unless otherwise agreed in writing.

  • Client may use deliverables for their own personal project use.

  • Client may not resell, reproduce, publish, or distribute Evara deliverables commercially without written permission.

 

13) Limitation of Liability

To the maximum extent permitted by law:

  • Evara is not liable for indirect, incidental, special, or consequential damages.

  • Evara’s total liability for any claim related to services is limited to the amount paid to Evara for the specific service giving rise to the claim.

 

14) Termination of Services

Evara reserves the right to pause, reschedule, or terminate services at any time if necessary to protect the business and maintain professional standards, including (but not limited to):

  • Non-payment or repeated late payment

  • Lack of communication that prevents progress

  • Repeated cancellations or no-shows

  • Abusive, harassing, or unsafe behavior

  • Misrepresentation, fraud, or chargebacks

  • Any circumstance in which continuing services is not feasible, professional, or safe, at Evara’s sole discretion

If services are terminated, Client is responsible for payment for work completed and any non-cancellable expenses incurred.

 

15) Force Majeure

Evara is not responsible for delays or inability to perform due to events outside reasonable control, including weather, natural disasters, supply chain disruptions, shipping delays, illness, or emergencies.

 

16) Disputes + Governing Law

These Terms are governed by the laws of the State of Oregon. Any dispute will be handled in good faith, and both parties agree to attempt resolution through written communication before pursuing formal action.

I7) Design Changes, Cancellations & Client Reconsideration

Once a design direction, concept, proposal, or scope of work has been approved by the Client, Evara Design Company LLC will begin implementing the agreed-upon services. This may include, but is not limited to, design development, material curation, sourcing, vendor coordination, scheduling, and preparatory work.

If the Client chooses to change their mind, cancel, pause, or alter the agreed-upon design after work has commenced, the following terms apply:

  • Evara is not responsible for a Client’s change of mind after approval has been given.

  • The Client will be invoiced for all work completed up to the point of cancellation or revision, including time spent on design development, sourcing, curation, coordination, and any associated administrative or consulting efforts.

  • Any materials already sourced, ordered, reserved, or scheduled are subject to vendor policies and may be non-refundable.

  • Any requested changes or new directions beyond the original approved scope will require a revised proposal and will incur additional fees.

  • Previously scheduled work, consultations, or installations may need to be rescheduled and are subject to availability.

Approval of a design, proposal, or scope constitutes acknowledgment that work may begin immediately and that fees incurred prior to any change or cancellation remain the responsibility of the Client.

Evara is always happy to explore adjustments or refinements when possible and will communicate all costs and next steps transparently before proceeding.

 

18) Updates to These Terms

Evara may update these policies periodically. The version in effect at the time of booking/purchase will apply to that service.

All content, branding, and materials on this website, including the Evara Design Company LLC name and logo, are owned by Evara Design Company LLC and may not be used without written permission.
